The Mapuche people requested an arbitration against Chile before the Permanent Court of Arbitration (PCA) in the Hague in which they seek the return of their lands and claim a breach of many of their rights. In a statement, the Mapuche Nation people announced the formal filing together with the Mapuche Permanent Mission before the United Nations, The Human Rights Mapuche Commission and the Kimche Comission for the Defenders of Wallmapu of an arbitration as well as the proposal of the Spanish judge Baltasar Garzón as arbitrator.

The statement that was published on 7 march 2023 explains that:

“In the face of historical appropriation of our ancestral and sacred lands, which has been and continues to be contrary to national and international law, which is a breach of the treaties in force and ratified by the Spanish crown and subsequently by the Chilean State, which have been unduly granted to extractive companies that are causing desertification, droughts, fires and pollution, which breach the rights of the nature and people’s dignity, as well as the progressive and systematic extinction of our culture, the Mapuche National People Ancestral Authorities, along with the Mapuche Permanent Mission to the United Nations, Human Rights Mapuche Commission and the Kimche Kimche Commission for the Defenders of Wallmapu (CKDDW in Spanish), we decided to file a request for arbitration against Chile before the Permanent Court of Arbitration in the Hague, nominating Mr. Baltasar Garzón Real as an international arbitrator on behalf of the Mapuche people.”

On his website, Baltasar Garzón has published Mapuche’s statement as well as a video in which he confirms to the president of the PCA and the authorities the acceptance of his nomination.

The Mapuche people claim their land restitution and adherence to treaties that have been ratified and are in force.
