By JIGGSLAW. The Colombian Transport Department and Caribbean Airport Group initiated a conciliation process in the context of International Airport Ernesto Cortisdoz’s arbitration in Barranquilla. The Caribbean Airport Group filed an arbitration against the Infrastructure National Agency (ANI) on September 21, 2021, for the impact of the COVID-19 pandemic on infrastructure traffic that has caused significant losses. The claimant is seeking compensation totaling 720,000 million Colombian pesos.

The arbitration was filed with the Bogota Arbitration and Conciliation Chamber, and the arbitral tribunal granted the parties a stay of proceedings to reach an agreement.

The Colombian Government Legal Department, which has been actively involved in a process where parties have stated their disagreements, has announced that the final round of negotiations will take place on January 23, 2022 (see “ANI shall respond to the GAC proposal this 23 January: Attorney General,” Vivian Narváez Ortega, El Heraldo, January 16, 2022). Arbitration proceedings will continue if no agreement is reached.

According to previously disclosed information, the Caribbean Airport Group sent a proposal to the Infrastructure National Agency (ANI), which included recognising a decrease in pandemic-related earnings, rescheduling work schedules, and making other contractual revisions. The Attorney General is also reviewing the proposal, as the arbitral tribunal has scheduled a conciliation process for January 26.

The Caribbean Airport Group is composed of the Colombian companies “Valores y Contratos,” “Equipo Universal,” and “Inversiones Millenium Azipo.”
